  • Acceptance of Terms
    • By accessing or using this website, portals, content, newsletters, or registering for events and programs, users agree to these Terms & Conditions and the linked Privacy Policy and Cookie Policy. Use of any specific service may be subject to additional terms presented at the point of use.
    • If a user does not agree to these Terms, they must cease use of all services and content immediately.

  • About the Organization and Services
    • The organization is a non-profit industry federation that advances professional standards, education, networking, and sustainable practices across the golf industry in Asia. Services include public websites, member portals, events and education, newsletters, industry publications, and collaboration with partners.
    • Services may evolve, be updated, suspended, or discontinued, with reasonable efforts made to notify users where changes materially affect access or obligations.

  • Eligibility, Accounts, and Accuracy
    • Services are primarily intended for industry professionals, organizations, and stakeholders. Where account creation is offered, users must be at least the legal age of majority in their jurisdiction and provide accurate, complete, and current information.
    • Users are responsible for safeguarding account credentials and for all activities under their accounts. The organization may suspend or terminate accounts for suspected misuse, fraud, or policy violations.

  • Membership and Programs
    • Membership categories, benefits, and eligibility criteria are detailed on program pages or application forms. By enrolling, members agree to comply with these Terms and the Code of Ethics, and to pay applicable fees when relevant.
    • Renewals, downgrades/upgrades, cancellations, and any refund rules are governed by the membership program terms presented at sign-up or renewal. Where not specified, fees are non-refundable once services are activated or benefits accessed.

  • Events, Education, and Bookings
    • Event registrations may include fee schedules, cancellation deadlines, substitution rules, credentialing, and venue policies. These specific event terms apply in addition to these Terms.
    • Organizers may modify event schedules, speakers, formats, capacity, or delivery method (in-person/virtual) for operational or safety reasons. Where possible, material changes will be communicated to registrants with available alternatives or remedies set out in the event terms.

  • Code of Ethics and Professional Conduct
    • Users and members are expected to act with integrity, respect, and professionalism, complying with applicable laws and the organization’s Code of Ethics. Unethical conduct, harassment, discrimination, or conflicts of interest may result in removal from programs, termination of access, or other remedial actions.
    • The organization may require cooperation in investigations of alleged misconduct related to services or events.

  • Acceptable Use
    • Users must not: violate laws; infringe intellectual property or privacy; post defamatory, fraudulent, or harmful content; introduce malware; attempt unauthorized access; scrape or harvest data without permission; or interfere with service operation.
    • The organization may moderate, remove, or restrict content or access at its discretion where it believes a violation or risk exists.

  • User-Submitted Content
    • Where features allow submissions (profiles, listings, abstracts, comments), users grant a non-exclusive, worldwide license to use, display, reproduce, and distribute the content for service operation, promotion of the relevant initiative, and archival or educational purposes.
    • Users warrant they have rights to their submissions and that content is accurate, lawful, and non-confidential unless otherwise stated. Submissions may be reviewed and removed for policy violations or legal risk.

  • Intellectual Property
    • All site content, graphics, logos, text, databases, videos, and compilations are owned by or licensed to the organization and protected by applicable laws. Except as expressly allowed (e.g., personal viewing or fair use), no content may be copied, adapted, or distributed without prior written permission.
    • Third-party trademarks and content remain the property of their respective owners. Any permitted uses must retain proprietary notices and attribution.

  • Third-Party Services and Links
    • The website and programs may integrate or link to third-party services (e.g., video platforms, analytics, payments, event platforms, social networks). Those services are governed by their own terms and policies, and availability or performance is not guaranteed by the organization.
    • Inclusion of links or tools does not imply endorsement. Users assume the risks associated with third-party interactions.

  • Payments, Invoices, and Taxes (if applicable)
    • Where fees apply (memberships, events, certifications, sponsorships), prices, tax treatment, billing frequency, and currencies are disclosed during checkout or in an invoice. Users are responsible for applicable taxes and currency conversion charges.
    • Payment disputes must be raised promptly with documented proof. Late payments may incur administrative charges or suspension of benefits until resolved.

  • Cancellations, Refunds, and Substitutions (if applicable)
    • Any cancellation, refund, and substitution rules are specified in program or event terms. Where unspecified, fees are generally non-refundable after access to benefits, materials, or reserved capacity is granted.
    • If the organization cancels a paid event or program, it will offer a refund or comparable alternative, subject to constraints outside its control (e.g., force majeure, venue rules).

  • Data Protection, Privacy, and Cookies
    • Use of services is subject to the Privacy Policy and Cookie Policy, which describe data practices, legal bases, international transfers, retention, and user rights, and provide cookie consent controls.
    • Users may adjust non-essential cookie choices through the consent manager and can unsubscribe from newsletters using the links provided in communications.

  • Warranties and Disclaimers
    • Services, content, and materials are provided “as is” and “as available.” The organization does not warrant uninterrupted or error-free operation, completeness, accuracy, or fitness for a particular purpose to the extent permitted by law.
    • Industry insights, research, or educational materials may involve third-party sources and professional judgment; reliance is at the user’s discretion.

  • Limitation of Liability
    • To the maximum extent permitted by law, the organization will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data, arising from or related to use of services.
    • Where liability cannot be excluded, it is limited to the amount paid, if any, for the specific service giving rise to the claim during the twelve (12) months preceding the event.

  • Indemnification
    • Users agree to indemnify and hold harmless the organization and its officers, staff, and representatives from claims, damages, liabilities, and expenses arising from misuse of services, breach of these Terms, or violation of third-party rights or laws.
    • The organization will provide prompt notice of any claim and reasonable cooperation; users must not settle any matter imposing obligations on the organization without written consent.

  • Compliance, Sanctions, and Export Controls
    • Users represent they are not subject to applicable sanctions or prohibited party lists and will not use services for prohibited purposes. Access may be restricted to comply with laws.
    • Users agree not to export or re-export content or technology contrary to applicable export control laws.

  • Suspension and Termination
    • The organization may suspend or terminate access with or without notice if it reasonably believes a violation, risk, or legal requirement warrants action.
    • Upon termination, rights granted under these Terms cease, but clauses intended to survive (e.g., IP ownership, disclaimers, limitations of liability, indemnities) remain in effect.

  • Changes to the Terms
    • The organization may update these Terms periodically. Material changes will be signposted on the site or via email to registered users where feasible. Continued use after the effective date constitutes acceptance of the updated Terms.
    • Users are encouraged to review the “Last updated” date and keep account contact details current for notices.

  • Governing Law and Dispute Resolution
    • These Terms are governed by the laws of the jurisdiction of incorporation or principal office of the organization, without regard to conflict-of-law principles.
    • Disputes will first be addressed through good-faith negotiations. If unresolved, the parties may agree to mediation or arbitration where permitted, or submit to the exclusive jurisdiction of competent courts in the governing venue. Mandatory consumer rights in a user’s home jurisdiction, if applicable, remain unaffected.

  • Force Majeure
    • The organization is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, public health emergencies, war, labor disputes, power or internet failures, or governmental actions.
    • Where possible, services will resume or be adapted once conditions permit.

  • Notices and Contact
    • Official notices must be sent to the contact addresses listed on the website’s Contact page or as otherwise designated in program documentation.
    • For legal or data protection queries, include sufficient identifying details and relevant context (e.g., membership ID, event booking reference) to facilitate a timely response.

  • Entire Agreement and Interpretation
    • These Terms, together with any referenced policies and specific program terms, constitute the entire agreement between the organization and users regarding the services, superseding prior understandings.
    • If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. Headings are for convenience only and do not affect interpretation.

  • No Waiver and Assignment
    • Failure to exercise a right or enforce a provision does not constitute a waiver. Any waiver must be in writing and signed by an authorized representative.
    • Users may not assign or transfer rights or obligations under these Terms without prior written consent. The organization may assign its rights in connection with restructuring or transfer of operations consistent with non-profit law and obligations.
